Anambra PDP faction threatens contempt charges against INEC

AS wrangling within the Anambra State chapter of Peoples Democratic Party (PDP), continues, the Ejike Oguebego faction has approached an Abuja Federal High Court, seeking form 48, notice of disobedience of court orders against the Independent National Electoral Commission (INEC).

In a suit No. FHC/ABJ/854/2014, Ejike Oguebego and Chuks Okoye vs PDP and 3 ors, the plaintiffs, are seeking the service of Form 48 (notice of consequences of disobedience to order of Court) on the second defendant, INEC, through Professor Mahmood Yakubu, Augusta Ogakwu, and Ibrahim Bawa (SAN), its chairman, secretary and Director of Legal Services, respectively.

Dated February 18, 2016, the suit urged the respondents to “take notice that unless you obey the directions contained in the order of the Honourable Court attached to this form (in particular the 5th Order restraining you from acting on list of nominated candidates except those that emanate from the Plaintiffs), you will be guilty of contempt of court, and you will be liable to be committed to prison.

The plaintiffs are also praying the court for an Order of perpetual injunction restraining 1st defendant, (PDP) its agents, servants, privies, assigns, -officials, whatsoever name they may be called from forwarding, sending or submitting to the 2nd defendant any delegates list, nominated candidates that may emerge from the congresses or primaries conducted by the purported caretaker committee set up by the 1st defendant for the PDP, Anambra State Chapter, except those that emanate from the plaintiffs’ congresses and primaries election.

Other reliefs sought by the plaintiff include: “Declaration that the 1st Defendant cannot legally and validly set up caretaker committee or any other body whatsoever when the orders of Interlocutory injunction made by this Honourable Court In Suit No: FHC/PH/(CS/213/2013 Now sUIT No. FHC/AWK/CS/247/2013- Ejike Oguebego & 2 Ors VS Peoples’ Democratic Party & 1 Ors (which order and Suit is also subject of pending Appeal before the Port- Harcourt Judicial Division of the Court of Appeal in Suit No: CA/PH/764/2013- Peoples’ Democratic Party; \/s Ejlke Oguebego & 3 Ors) is still-subsisting and subject of an Appeal.
